The terms and conditions relating to the booking, operation of, and payment for an on-demand flight through BlackJet Inc. (“BlackJet”) on behalf of the individual or entity requesting the on-demand flight service (“Client”) are set forth below. BlackJet and Client are sometimes referred to in these terms and conditions individually as a “Party” and collectively as the “Parties.” BlackJet Inc. is not an air carrier and does not own or operate any aircraft. BlackJet Inc. acts as a principal or agent depending on the type of air transportation being provided. All flights sold as a principal or arranged as an agent by BlackJet Inc. are operated by independent, third-party FAA-licensed and DOT-registered air carriers.

Flights arranged by BlackJet for Client are performed by independent, third-party FAA-licensed and DOT-registered air carriers (each, an “Air Carrier”) that have undergone BlackJet’s safety and compliance screening. The Air Carrier assigned to your flight will be disclosed with your booking confirmation.

Instant Book is BlackJet’s guaranteed pricing and availability feature. BlackJet guarantees the quoted price and aircraft availability, ensuring no additional costs to confirm your booking on the selected aircraft or a comparable model within the same category. Sliding departures may apply to non-member bookings; exact times will be confirmed at booking. Most domestic flights booked more than 72 hours in advance qualify for Instant Book. Bookings made directly with BlackJet’s team will be clearly identified in writing if they qualify.

BlackJet provides complimentary flight recovery to active Jet Card Members. If any issue arises with an aircraft after booking, BlackJet will offer at least one comparable alternative at no additional cost. Members may accept the alternative, request additional options (subject to cost), or receive a full refund in BlackJet Credit. Non-members may receive paid alternatives or a refund in BlackJet Credit. Complimentary recovery does not apply to flights categorized as Empty Legs.

Client acknowledges that the total cost of the trip may vary due to increased taxi or flight time from ATC delays, weather diversions, TFRs, customs delays, or alternate airport use. Additional costs such as fuel surcharges, Wi-Fi, hangar, deicing, crew expenses, special event fees, and international fees will be billed at cost. Optional add-ons (ground transportation, catering, special stock requests, etc.) will include a service fee. Final invoicing may take up to six months. Client agrees to indemnify and reimburse BlackJet for any expenses incurred on their behalf.

Client must comply with all TSA and government regulations. A valid ID is required for all flights, and a valid passport (and visas, if applicable) for international travel. BlackJet may share passenger information with the Air Carrier as needed. The Air Carrier may refuse boarding to any passenger without proper documentation or in violation of regulations without liability to BlackJet.

Changes may be made up to 72 hours prior to departure, subject to aircraft and crew availability and any applicable cost adjustments. Requests must be submitted in writing to flights@blackjet.com. Cancellations within policy or no-shows (including arrivals more than 15 minutes late) forfeit 100% of the flight cost.

Flights on midsize or larger aircraft are non-refundable once confirmed.
Members: Flights canceled at least 48 hours prior to departure receive a 100% refund in BlackJet Credit.
Non-Members: Flights canceled at least 72 hours prior to departure receive a 100% refund in BlackJet Credit.

BlackJet is not liable for injury, loss, expense, or consequential damages resulting from any act, omission, or occurrence outside its control, including mechanical failure, delays, cancellations, weather, war, strikes, or other events.

Neither BlackJet nor its contracted Air Carriers shall be liable for failure to perform due to Force Majeure, including but not limited to: acts of God, war, terrorism, pandemics, quarantines, TFRs, embargoes, strikes, or safety-related cancellations. If a flight is canceled for these reasons, BlackJet will provide the remedies outlined in “Responsibility” above.

BlackJet does not own or operate aircraft and does not carry aviation insurance unless stated otherwise. The Air Carrier is solely responsible for maintaining required liability insurance. Certificates may be provided upon request.

Passengers must notify BlackJet at booking if transporting firearms or hazardous materials. Firearms are permitted only if declared and transported per FAA/TSA regulations and inspected by Air Carrier personnel.

Pets are generally permitted with prior approval and may be subject to fees or aircraft limitations.

Due to aircraft performance limits, Clients must provide accurate passenger and baggage weights. The Pilot-in-Command has final authority on all load decisions. For flights booked within 48 hours, full passenger and luggage details are required at booking.

All international trips are tentative pending permits and authorizations. BlackJet will communicate any unique cancellation terms specific to international operations.

Flights into major or congested airports may require slots or permits, potentially impacting actual departure and arrival times. BlackJet is not responsible for delays due to such restrictions. Members requesting flights into major airports may incur additional costs.

The Client is responsible for providing accurate contact details for all passengers. If the Client is also a passenger, an alternate contact not onboard must be designated. This contact will handle communications in the event of an incident.

Client agrees to indemnify and hold harmless BlackJet, its affiliates, officers, employees, and agents from any losses, claims, or liabilities arising from Client’s negligence, misconduct, or violation of third-party rights, except where such losses result from BlackJet’s gross negligence or willful misconduct.

Any dispute not resolved within ninety (90) days of written notice shall be submitted to binding arbitration in accordance with rules accessible at https://www.blackjet.com/legal/

BlackJet values Client privacy. By using BlackJet’s services, Client consents to information handling as described in BlackJet’s Privacy Policy available at https://www.blackjet.com/legal/

Quoted prices are valid on the date issued. Flights are confirmed upon payment. Prepayment via credit card or wire is required. Credit cards may be pre-authorized to secure bookings.

Empty legs are aircraft- and route-specific, subject to availability, and non-refundable once booked. Changes are not guaranteed and may incur additional costs. Complimentary recovery does not apply to Empty Legs.
